We receive the information you choose to provide when using our Services. For example, in connection with certain uses of our Services, such as when you create an account, book classes or self-led kiosk sessions, purchase packages or gift cards, sign up for communications, or contact us directly, you may be asked to provide information about yourself including:

  • Identifiers such as your first and last name, username, mailing address, phone number, email address, and date of birth (where required by our booking system).

  • Commercial information, including payment-related information (which is processed by our payment processor) and a record of your purchases, bookings, and services you have obtained from us.

  • Information about your preferences, such as class preferences, schedule preferences, and communication preferences.

  • A photograph or profile image if you choose to upload one or if required by our client platform for identification.

  • Other information about your use of our Services that you choose to provide if you contact us directly (for example, questions or comments you submit).

We do not currently request detailed medical or health history through our online booking system. If you voluntarily share health-related information with us in person, by email, or through forms, we will use that information only for the purposes for which you provide it (for example, to help tailor your experience in class or to address safety concerns), and we will treat it with appropriate care. You should avoid sharing more sensitive medical details online than necessary.

We also collect or receive information when you use our Services. Some of this information is collected using cookies and similar technologies. This information may be combined with information that you provide us directly in order to personalize your experience.

Depending on how you access and use our Services, we may receive:

  • Internet or other electronic network activity information. This includes information we automatically collect and store when you use our Services, such as:

    • Information about your interactions with our Services, including the pages you view, the classes or products you view or purchase, the time spent on our website, and the date on which you accessed our Services.

    • Information in cookies and similar technologies.

    • The type of device you are using (e.g., phone, tablet, desktop).

    • Certain device identifiers which may be unique to your device.

    • Your internet service provider.

  • Location information. We may receive approximate location information derived from your IP address or device settings. We do not provide GPS-based location services, but our platforms may use general location to help display relevant information, such as nearest classes or to prevent fraud.

  • Inferences. We may generate inferences about your preferences and characteristics based on your use of the Services, such as preferred class times or membership type, to help tailor your experience.

Information from Third-Party Sources

  • Marketing and analytics partners. If we use marketing or analytics tools in the future (for example, email marketing tools or ad platforms), we may receive information about your interactions with our emails or advertisements, which helps us understand engagement and improve our communications.

2. How We Use the Information We Collect and Receive

  • Better understand the visitors and clients who use our Services and the content, classes, and offerings of interest to them.

  • To perform internal analysis and build models to better understand client engagement and preferences so that we can customize and improve our Services and communications.

At this time, we do not share your personal information with third-party business partners for their own direct marketing purposes. If this changes in the future, we will update this Privacy Policy and obtain any required consent.

We may also use the information we collect and receive for other purposes that may be described to you at the point of collection or for which you provide your consent.

Other Parties in Response to Legal Process or When Necessary to Protect Us or Our Services
We or our service providers may disclose your information – including the contents of your communications – to other parties when required or permitted by applicable law, such as when we have a good faith belief that:

If such a transaction occurs, we will notify you in an update to this Privacy Policy or through another appropriate means.

We may also share other information with third parties in a manner that does not identify particular users, including, for example, aggregated or de-identified information.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Third Parties That Provide Content or Functionality on Our Services

Some of the content and functionality on our Services may be provided by third parties that are not affiliated with us. Such third parties may include, for example:

If we use social networking or advertising services in the future (for example, tools that allow you to log in with social accounts or share content to social media), those services may collect information about you even if you do not click on or interact with their content directly on our Services. Any such use will be described in an updated version of this Privacy Policy.

5. Your Choices

You have a number of choices about how we handle information we collect and receive about you.

Access, Update, or Delete Information
Subject to applicable law, you may request to access, update, or delete certain personal information we hold about you by contacting us at hello@newheightspilates.com. We may request further information from you to verify your identity and help us respond to your request (for example, confirmation of certain account details). In some cases, we may need to retain certain information for legal, accounting, or legitimate business purposes.

Location Information and Cookies
You may be able to limit the collection of your location information through your device settings. You can also adjust cookie and tracking settings in your browser. Please note that if you refuse or disable cookies, some features of our Services may not function properly.

6. Security

We have adopted physical, technical, and administrative safeguards to help protect against theft, loss, misuse, and unauthorized access to or disclosure of the information we collect and receive. However, no data transmission or storage system can be guaranteed to be 100% secure. As a result, while we strive to protect your information and privacy, we cannot and do not guarantee or warrant the security of any information you disclose or transmit to our Services and cannot be responsible for the theft, destruction, or inadvertent disclosure of your information, or any other disclosures out of our control.

Your access to certain information may be protected by a password. We strongly recommend that you select a unique password that is difficult to guess and that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls, or email messages).

7. Children’s Privacy

Our Services are not intended for children under the age of 13, and we do not knowingly collect, use, or disclose personal information from children under the age of 13 without prior parental consent, except as permitted by law. If we become aware that we have collected personal information from a child under 13 without appropriate consent, we will take steps to delete such information.

Clients under the age of 18 must have a parent or legal guardian complete any required registration and consent forms and agree to our policies on their behalf.

8. Third-Party Links

Our Services may contain links to other sites or services that we do not own or operate. We provide these links as a convenience to our users. These links are not intended as an endorsement of or referral to the linked services. The linked services should have separate and independent privacy statements and terms of use, which we encourage you to read carefully. We do not have any control over such services and therefore are not responsible for the manner in which the entities that operate such linked services may collect, use, disclose, secure, or otherwise treat your information.

9. State Privacy Rights

This Privacy Policy describes our practices for handling personal information for clients primarily located in the United States. Because New Heights operates a single studio in New Jersey and does not target or regularly serve residents of particular states with enhanced privacy laws (such as California), this section provides general notice rather than state-specific disclosures.

Depending on where you live, you may have certain rights under applicable state privacy laws, which may include the right to:

  • Request access to the personal information we hold about you.

  • Request deletion of personal information, subject to certain exceptions.

  • Request correction of inaccurate personal information.

  • Opt out of certain types of data sharing or sales, where applicable.

You may exercise these rights, if they apply to you, by contacting us at hello@newheightspilates.com. We may request additional information from you to verify your identity and respond to your request as required by law.

If we later become subject to specific state privacy regimes based on our operations (for example, California or other states’ laws), we may update this Privacy Policy to include more detailed information regarding those rights.

10. International Visitors

Our studio and Services are based in the United States and are primarily intended for individuals located in the United States. If you access our Services from outside the United States, please be aware that your information may be transferred to, stored in, and processed in the United States or other countries where our service providers are located. Privacy laws in these jurisdictions may be different from those in your country of residence.

By using our Services, you acknowledge that your information may be processed in the United States and that we will handle your information in accordance with this Privacy Policy.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our privacy practices, our Services, or applicable laws. When we do, we will revise the “Last Updated and Effective Date” at the top of this page. We encourage you to review this Privacy Policy periodically to stay informed about our information practices. If we make significant changes, we will provide appropriate notice, which may include posting a prominent notice on our website or sending you a direct communication.
